Hispanic Federation: Attempt to End Birthright Citizenship Threatens Constitution and Could Cause Irreparable Harm for Children Across the Country
Washington, D.C. – Today, the Supreme Court heard oral arguments in Trump v. Barbara, a case that could end birthright citizenship in the United States. Below is a statement from Frankie Miranda, President and CEO of Hispanic Federation.
“Hispanic Federation stands unequivocally in defense of birthright citizenship – a right enshrined in the Constitution of the United States for more than 150 years. Citizenship is not a political decision, and the arguments presented at SCOTUS threaten to politicize citizenship in an extremely dangerous way.
The 14th Amendment was ratified in the aftermath of the Civil War to establish that citizenship in this country is determined by birth on American soil, not by the nationality, immigration status, or circumstances of one’s parents. Turning our back on this would be the equivalent of turning our back on the long history of those who built this country, started families, and became integral to the fabric of our nation today.
We are particularly mindful today of the children who are born to immigrant parents whose futures hang in the balance. These are American children, and the elimination of birthright citizenship would create an overbearing roadblock that could prevent children from being able to learn, grow, and eventually become a part of the society where they were born. The suggestion that any child is less American because of who their parents are is not only legally wrong, but also morally unconscionable.
The President’s executive order is plainly unconstitutional. His attendance at today’s oral arguments is unprecedented and gives the clear appearance of attempting to intimidate the Justices of the Supreme Court, undermining the Court’s independence and the integrity of the judicial process.
We are Americans, and we will fight to protect the rights of every child born on this soil to continue being recognized as a part of our nation. We call on the Supreme Court to reject President Trump’s unconstitutional executive order and uphold Birthright Citizenship, a right that has been upheld multiple times by the Supreme Court historically and is the law of the land.”
